These terms explain exactly what you may and may not do with any website you buy or commission from Wondercraft. The licence types below are always shown as currently offered.
1. About this agreement
This Terms of Licence and End User Licence Agreement ("Agreement") is a legal agreement between you (the person or organisation buying or using a website, the "Licensee") and Wondercraft ("we", "us"). It applies to every website build, template, source code, design, documentation and related files supplied by us, whether bought from the marketplace or delivered as a custom build (together, the "Product").
By purchasing, downloading, installing, copying, modifying or using the Product, you agree to this Agreement and to the licence type shown on your order, certificate and licence key. If you do not agree, do not use the Product and contact us within the refund period set out in our refund policy.
If you accept on behalf of a business, you confirm you have authority to bind that business.
2. Definitions
"Licence Type" means one of the licences described in section 4. "Production Domain" means a live, publicly accessible address where the Product is used by visitors or customers. "Staging Address" means a private copy used only for building, testing or previewing — for example a staging subdomain, a preview link or localhost. "End Client" means a separate, paying third party for whom you build a website under an Agency or Extended Licence. "Licence Key" means the unique code issued for your purchase.
3. Grant of licence
Subject to payment in full and your compliance with this Agreement, we grant you a perpetual, worldwide, non-exclusive (except for the Exclusive Licence) and non-transferable licence to use, copy and modify the Product within the limits of your Licence Type.
The Product is licensed, not sold. Except under the Exclusive Licence, we keep all ownership, copyright and other intellectual property rights in the Product and its underlying framework, and the same design may be licensed to other customers. Content you add — your text, images, logos and data — remains yours.
Every licence includes the full source code. You may host it anywhere and have any developer maintain or extend it for the permitted use.
4. Licence types
Your rights depend on the Licence Type on your order. Each licence includes the rights below in addition to sections 3 and 5.
Standard Licence
One business, one primary domain, forever.
The standard licence. You get the full source code, you may modify it forever, and you may run it for one business on one primary domain.
1 production domain · staging and development exempt
Permitted
Run the website for one business on one primary domain
Modify the source code however you like, forever
Have any developer maintain, update, or extend it
Keep the website running indefinitely after our relationship ends
Not permitted
Resell, sub-licence, or redistribute the website build as a template or digital asset
Deploy a single purchase across multiple unrelated businesses
5. General restrictions (all licences)
Unless your Licence Type expressly permits it, you must not: (a) resell, sub-license, lease, share or redistribute the Product, or any part of it, as a template, theme, plugin, starter kit or other standalone digital download; (b) publish the source code publicly or include it in an open-source or template pack; (c) use one purchase for more businesses, End Clients or Production Domains than your Licence Type allows; (d) remove, bypass or tamper with licence verification; (e) use the Product for anything unlawful, fraudulent, defamatory or infringing; or (f) claim the original design as your own work when offering it for sale to others.
Template marketplaces, theme stores and automated distribution of any kind are prohibited under every Licence Type.
6. Marketplace purchases and upgrades
Marketplace websites are not sold only once; other customers may licence the same design. Where a marketplace licence is marked as upgradable, you may move up to a higher marketplace licence from your customer area by paying the difference shown.
Marketplace purchases can never be upgraded to the Exclusive Licence. The Exclusive Licence exists only for custom builds made specifically for one client.
7. Custom builds and the Exclusive Licence
Every custom build includes the Exclusive Licence at no extra cost. A custom build is designed and developed specifically for you; it is never listed in our marketplace catalogue and never sold to any other customer.
On full payment, you receive exclusive rights to use, modify, deploy and host the bespoke build for your business without a domain limit. We may keep and reuse general know-how, generic code libraries and non-specific components that are not unique to your project, but we will not resell your bespoke design.
You may not resell or redistribute the custom build as an off-the-shelf template or theme download.
8. Domains and staging addresses
Your Licence Type sets how many Production Domains you may use. Staging Addresses do not count towards that allowance where the licence says staging is exempt. Domains are registered against your Licence Key in your customer area, and additional domains need an upgrade or an additional licence.
9. Licence keys and verification
Each paid purchase receives a unique Licence Key shown in My Licences, on your certificate and in your purchase emails. Keep it confidential. The Product may check its key and domain with our licensing service; we only receive the information needed for that check.
Licence keys may be transferred to another person only through the transfer feature in your customer area, after which the original holder's rights end. We may reissue a compromised key.
10. Updates, support and third-party components
Updates, security patches and support are provided only as described on the listing or under any separate care plan you buy; a Licence Key is not a promise of future updates. The Product may include open-source or third-party components licensed under their own terms, which take priority for those components.
11. Suspension and termination
If you materially breach this Agreement, we may suspend or revoke your Licence Key after giving you notice and a reasonable chance to put things right, unless the breach cannot be fixed (for example, reselling the Product as a template). On termination you must stop using the Product beyond any rights already lawfully granted to End Clients. Sections on ownership, restrictions, liability and governing law survive termination.
12. Warranties and liability
We will supply the Product with reasonable care and skill and as described. Apart from that, and to the extent the law allows, the Product is provided "as is" without other warranties, including fitness for a particular purpose or uninterrupted operation once modified or hosted by others.
We are not liable for indirect or consequential loss, lost profits, lost data or business interruption. Our total liability under this Agreement is limited to the amount you paid for the Product concerned. Nothing in this Agreement limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.
13. General
This Agreement, together with your order and any separately agreed written terms, is the entire agreement about the licence. If any part is found unenforceable, the rest continues to apply. We may update these terms for future purchases; the terms in force when you bought apply to that purchase. Do not use our name or trademarks to imply a partnership without permission.
This Agreement is governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without removing any protection you have under the law of the country where you live as a consumer.
